II- Payment

a. Commissioner are obligated to deposit at least 50% of the full amount calculated by the artist(s) that is agreed by the artist and commissioner. Work will not start when deposit are not made 

b. Commissioner may pay full amount during deposit phase at his own risk during refund.

c. If payment are over 400 USD and are over the expense payable by the commissioner, the payment shall be divided to maximum of four progress payment, terms negotiable.

d. As per Clause II (a), Work with interval payment cannot start until amount reaches required deposit amount.

e. Payment do not include any external fees added upon it such as Paypal Fees or any form of taxation fees. 

f. Final account is defined as any remaining amount due to the artist(s) including any additional or deduction of fees encounter during works. 

g. If final account is not paid, the commissioner will not receive the finished version of the art.

h. Payment can only be made in Paypal in United States Dollar or Japanese Yen as currency. Payment in other currency are negotiable.

III. Cancellation

a. When cancellation is made after drafts were sent and agreed, only 40% of the deposit will be refunded. 

b. When cancellation is made before drafts were sent and agreed, full refund will be made.

c. Cancellation of works due to failure to finish the works on time grants commissioner to retain full refund but the artwork will not, in any percent to completion, given to the commissioner.

d. When commissioner have made any form of approval indicating permission to proceed beyond base color, refund of any form will no longer be entertained.


IV. Artist's Rights

a.  Artist(s) reserve the rights to change prices and description of terms and condition at anytime without prior notice; However once the transaction has been made and the commissioner's slot was booked. commissioner are not affected by any price increase or discounts and shall follow the terms and condition before update. 

b. Artist(s) reserve the rights to reject any commission before and after deposit was paid. If deposit is already paid, 100% refund of amount paid will be made upon rejection.

c. NSFW are generally allowed, however; a few categories that are not acceptable include but not limited to: 
-anything to do with excrement (anything deemed disgusting by the artist(s) in general) 
-too weird of a fetish (weirdness of fetish will be judged by the artist(s) definition)
-bust or butt size that are oversize or tumor-like 

d. Enlargement in breast or butt size in character that do not belong to the commissioner will not be entertained. Unless the artist(s) was shown with EVIDENCE that the designer her/himself allows it. In other words, the artist(s) will try to follow the proportion of the original character as closely as possible. 

e. When commissioner failed to reply artist for any form of inquiry and/or confirmation within 48 hours after message sent to whichever medium, the artist have the right to work on commissioner next in line to completion whether or not commission are with deadline. 

V. Commission with Deadline

a. Brief for commission with deadline must be given more than 14 days before the due date. The brief must be expressed clearly that commission to be completed on due date along with the required information. 

b. When work cannot start due to incomplete brief and commissioner fail to reply within 12 days before due date, the commissioner will be charged extra of 50 USD. 

c. When commissioner provided the brief and allow the artist less than 14 days to work on the artwork the artist may; 
i. Reject the commission under Clause IV(b)
ii. Impose 50 USD extra on the commission

d. If work failed to complete on due date, the artist may;
i. grant commissioner refund under Clause III(c)
ii. if the commissioner so insist the work to be done, the artist may continue the work with an extension of time.

e. Commissioner will not be entitled to refund if commissioner rejects artwork completely, changes artwork significantly or ignore finalization process.

f. When deposit is paid without expression of due date, the work will be implied to be work without deadline.

h. If the commissioner insist to have work done before deadline after payment of deposit, the commissioner will be charged an additional 10USD fees whether or not time allowed for the artist to complete work before deadline is more than 14 days. If time provided is lesser than 14 days, commissioner shall pay an additional 15USD under Clause V(b)

VI. Variation Order

a. No fees shall be charged when variation ordered is small and insignificant. Significance of variation shall be under judgement of the artist(s).

b. 60 USD fees will be additionally charged when the commissioner rejects the entire artwork completely or changes the artwork significantly.

VII. Copyright Policy

b.  Re-uploading and watermark a non-watermarked version of the commissioned artwork are strictly not allowed. Artwork re-uploaded as such shall be reported under plagiarism.

c. Artwork without signature are strictly only for personal use only. For publication purpose, commissioner must use the uploaded artwork with artist(s) signature from any channel that consist the artwork and include the link as well as crediting the artist. 

VIII. Agreement to Terms of Service

a. By paying the deposit, the commissioner is deemed to have read the additional notes and agreed to the terms of service set out by ArsonicArtz and (or) his collaborators.
